Terms and Conditions
Last updated:
These Terms and Conditions govern the use of haychanga.com and of the apps in the HayChanga ecosystem (Avati, Noticias, Changas and any added later), as well as the HayChanga account that gives access to them. By creating an account or using the services, you accept these terms and the Privacy Policy.
1. Who we are
The services of the HayChanga ecosystem ("HayChanga") are offered through haychanga.com and its apps, from Uruguay. For now, the contact channel is WhatsApp: +598 94 576 598.
2. The services
The HayChanga ecosystem includes:
- Avati: an interactive character for a business's screens, managed from a web dashboard and shown on TVs, totems or kiosks (interactive, automatic, ads, news, mixed and multimedia modes).
- Noticias: a public portal with today's headlines from Uruguay, Argentina and Brazil, exchange rates and the weather.
- Changas: a place to post odd jobs ("changas") and find someone to do them.
- haychanga.com: the site that presents the apps and publishes these documents.
Some features may be in development or unavailable in some countries.
3. The HayChanga account
One HayChanga account works for every app that requires one. To create it you must be over 18 and provide accurate information (name and email).
You are responsible for keeping your password secret and for activity in your account. If you suspect unauthorized use, change your password and let us know.
Each account belongs to an organization. In Avati, the organization holds the plan, the screens and the content uploaded.
4. Acceptable use
You may not use the services to:
- publish content that is illegal, misleading, discriminatory, violent, sexually explicit or that infringes third-party rights;
- impersonate another person or company;
- try to access accounts, data or systems without permission, or get around your plan's limits;
- send spam or automate use in a way that harms the service;
- on Changas, offer or request jobs that are illegal, dangerous or exploit other people.
We may remove content or suspend accounts that break these rules.
5. Your content
Content you upload (questions, ads, images, logos, video links, job posts) remains yours. You grant us a non-exclusive, free permission to store, process and display it only to provide the service (for example, showing your ads on your screens).
You confirm you have the necessary rights to that content. Videos are played from YouTube and are also subject to its terms.
6. Avati: plans, payments and screens
- Trial: without a subscription, Avati works with limits (for example, presentation time and number of screens).
- Subscriptions: plans are billed monthly, in Uruguayan pesos, through Mercado Pago, and renew automatically until you cancel. HayChanga does not store card data: payments are processed by Mercado Pago under its own terms.
- Screens: each plan allows a number of screens. A device counts as a screen when it starts Presentation Mode.
- Plan changes: when upgrading, the new limit applies immediately and the new price from the next charge; when downgrading, the change applies at the end of the paid period.
- Cancellation: you can cancel at any time from the dashboard. You keep the plan until the end of the period already paid; partial periods are not refunded unless the law requires otherwise.
- Failed payments: if a charge fails, you keep the plan during a grace period; if it is not resolved, the account returns to trial limits. We do not delete screens or content because of this.
- Prices: we may change prices with at least 30 days' notice; the change applies to later charges.
7. Avati: camera and gestures
In interactive mode, Avati uses the device's camera to detect people and gestures (wave, thumbs up or down). This processing happens on the device itself: no images are stored or sent, and people are not identified.
Whoever installs the screen is responsible for informing people who approach it that a camera is active, as required by applicable law.
8. Noticias
Headlines come from third parties (news providers and the outlets themselves); exchange rates and weather come from third-party public services. They are shown for information only: we do not guarantee their accuracy or that they are up to date, and they are not financial advice. Links lead to third-party sites with their own terms.
9. Changas
Changas only puts people who offer an odd job in touch with people who do it. HayChanga is not an employer, contractor or payment intermediary, and is not a party to agreements between users.
Each user is responsible for what they post and agree to: price, payment method, quality, safety, permits and employment or tax obligations. We recommend checking information and acting with care. You can report posts or users that break these terms.
10. Third-party services
To work, we use providers such as Supabase (database, authentication and files), Vercel (hosting), Mercado Pago (payments), YouTube (videos) and sources of news, exchange rates and weather. Their availability does not depend on us.
11. Intellectual property
The HayChanga, Avati, Noticias and Changas brands, the Avati character, and the software and design of the services belong to HayChanga or its licensors. These terms give you no rights over them beyond using the services.
12. Availability and changes to the service
We do our best to keep the services running continuously, but there may be interruptions due to maintenance, failures or external causes. We may modify, add or remove features; if we remove a paid feature, we will give you advance notice.
13. Liability
To the extent permitted by law, the services are provided "as is" and HayChanga is not liable for indirect damages, lost profits or data loss arising from their use, nor for content from users or third parties. Nothing in these terms limits the rights you have under applicable consumer protection law.
14. Suspension and account closure
You can ask us to close your account at any time by messaging us on WhatsApp at +598 94 576 598. We may suspend or close accounts that break these terms, with notice when possible.
15. Changes to these terms
We may update these terms. The "last updated" date shows the current version. If a change is significant, we will tell you and, where appropriate, ask you to accept it again.
16. Governing law and jurisdiction
These terms are governed by the laws of the Oriental Republic of Uruguay. Any dispute will be submitted to the competent courts of Uruguay, without prejudice to the rights the law grants consumers.
